Services Provided by Payso
"You", "Customer" or "Buyer" or "User" : A Customer that applies to, or registers to use, or uses, the Service to make Payment Transactions.
"Payso", "We" or "us": means Payso Fintech Pvt. Ltd.
"Issuer": Shall mean any bank/entity with whom customer holds an account,wallet or Credit line.
"Merchant" or "Seller": A seller of goods or services who has registered with Payso or Financial Institution in order to use the Service to make sales through his Mobile application/web site/electronic catalogues/retail establishment or other outlet.
"Merchant Establishments": The web site pages/electronic catalogues/retail establishments/ other outlets of Merchants affiliated with Payso. or Financial institution in respect of the Service.
"Payment Instrument": Shall mean the bank account or wallet or credit account or other type of account in the name of and help by the customer and which can be operated by internet banking or mobile or any Physical form factor"Payment Transaction": The processing of a payment through the Service that results in the debiting or charging of the Purchase Amount to a Buyer?s Payment Instrument and the crediting of funds to a Merchant. "PIN" or "Pattern": Payso or Financial Institution issued code to Buyer to authenticate Payment Transactions at the time of making a payment. "Product/s": Any merchandise, goods or service that is listed for sale by the Merchant that a Buyer may avail or pay for, using the Service. "Purchase Amount": The amount of a Payment Transaction to pay for a Product, and any related fees, taxes or shipping charges, as applicable in the currency designated by the Merchant. "Service": This Payso service, described in these Terms of Service, that Payso offers to its customers.
Payso is a payment service provider and helps customer to make digital or cashless payments to merchants. Payso does not sell any goods or services and is only a technology provider of payment mechanism for goods and services sold by merchants who have signed up with Payso. Payso is not a warrantor, insurer, or guarantor of the goods & services provided by the merchants. Any disputes regarding the quality, cost, expiration, or other terms of the goods or services purchased must be handled directly between You (or the recipient of the good or service) and the merchant.
If you are a child under 18 years of age, we may need your parent or guardians consent before allowing you to use the service. This Site is intended for use by you only if you are 18 years of age or older. The service is not available to any users previously suspended or removed from the service by Payso. If you are using or opening an account to use the site on behalf of a company, entity or organization (each a "Subscribing Entity"), then you represent and warrant that you: (i) are an authorized representative of that subscribing entity with the authority to bind such entity to these Terms, and (ii) agree to be bound by these Terms on behalf of such subscribing entity. Additionally, users are prohibited from transferring their Payso account to another party. If you do not qualify, you may not use the Payso Service.
You further represent and confirm that you are not a person debarred from using the Payso website and/or receiving the Payso Services under the laws of India or other applicable laws. You represent and warrant that you have that right, authority, and capacity to enter into this agreement and to abide by all the terms and conditions of this agreement. You shall not impersonate any person or entity, or falsely state or otherwise misrepresent identity, age or affiliation with any person or entity. You acknowledge that the Services may be subject to restrictions imposed by the laws, rules, regulations, and guidelines in force in India.
Registration for Payso
User Name and Password
You must choose a reasonably descriptive User name that clearly identifies you. This name may appear on the Buyer Account statement. If a Transaction dispute results from your failure to use a reasonably descriptive user name, you agree to indemnify Payso for any costs stemming from such dispute. As part of the Payso registration process, you will create a password for your Payso Account. You are responsible for maintaining the confidentiality of the Account login information, password, one time password (OTP) and PIN secure, and are fully responsible for all activities that occur under the Payso Account, including, without limitation, all actions by sub-users registered under the Payso Account. You agree to (a) immediately notify Payso of any unauthorized use of your password or the Payso Account or any other breach of security, and (b) ensure that you exit from your Payso Account at the end of each session. Payso cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this Clause or from any unauthorized access to or use of the Payso Account. In the event of any dispute between two or more parties as to ownership of a particular Payso Account, you agree that Payso will be the sole arbiter of such dispute, at its sole discretion and that Payso?s decision (which may include termination or suspension of any account subject to dispute) will be final and binding on all parties.
Payso provides payments option to the customer to register RBI regulated mobile wallets or credit accounts or Bank account details with participating issuers with Payso while doing online shopping on merchant portal/app or on standalone Payso App as per the process and terms and conditions agreed with the respective participating issuers. Payso processes Payment Transactions on behalf of Merchant, as the payment processing partner of the Merchant. The Customer can then select any of the Registered Payment Instruments or add a new Payment Instrument to make the transaction. The online payment process specific to your Payment Instrument will then be implemented. When customer chooses to pay for Products with the Payso Service, Customer authorizes the Merchant to submit charges (and, in the case of refunds, credits) to Customer's registered Payment Instrument. Once Customer's registered Payment Instrument is authorized, Customer's payment obligation to Merchant shall be deemed completed and discharged (except for chargeback or other reversal). Purchases made are also subject to the terms and conditions governing customer's Payment Instrument between customer and the issuer of the Payment Instrument. Customer is responsible for any charges and related fees that may be imposed under the Payment Instrument terms and conditions as a result of Customer's use of a Payment Instrument. You acknowledge and agree that your purchases of Products are transactions between you and the Merchant, and not with Payso.
Authorization to debit your linked bank or wallet (PPI).
If you register a bank account or Wallet (PPI) or credit account as per the process set by payso which is accordance and agreement with the respective participating issuer you are authorizing Payso and the issuer Partner to initiate an electronic transfer from your linked bank / Wallet (PPI)/Credit account in the amount you specify. You are solely responsible for complying with any terms set by your bank or wallet provider with respect to your account, including any fee terms, such as non-sufficient fund or overdraft fee terms. If you are entitled to a reversal, refund, or other adjustment associated with a payment you made using the Payso Services, you also authorize Payso and the Financial Institution Partner to credit your linked account to complete that transaction.
You are limited on the amount of money that can be used for per transaction per month from linked Account/wallet/credit account. The per transaction and monthly limit is decided by Issuer or by Payso. We and Issuer reserve the right to decrease your transaction limit at any time, for any reason without any liability.
Increase or decrease in limits
You can increase and decrease the limits set per account in accordance to the limits set by your Iissuer and by following the process set for the same.
Reversals or Chargebacks.
Any payment that you receive may be reversed if: (a) the sender requests a reversal of the payment if the terms of the service are not met, (b) the sender?s bank requests a reversal of the payment, or (c) Payso decides a Dispute against you (each a "Reversal"). You are liable to Payso for the full amount of any payment that you receive that is subject to a Reversal, and the Reversal Fee, if applied. You will not receive a refund of any Payso Fee that you may have paid.
Authorisation to recover Due amount
You authorize Payso and the issuer Partner to take any of the following actions to recover the reversal amount from you:
Debit the bank/wallet/credit account linked to your Payso Account;
Suspend your Account and require your immediate payment; or Engage in collection efforts.
If required Payso shall be entitled to collect and store relevant information and documents provided by the Customer to the Platform for KYC purposes. Further, as and when required, the customer will be required to provide additional documents for fulfilling the KYC requirements. You authorize Payso to make such enquiries as they may feel necessary to satisfy themselves about the validity of your identity. You undertake to update us in case of change of your existing information or verification documents provided by you.
We reserve the right to terminate any account, with or without notice to you, in the event the KYC documents / information are found to be incorrect or authenticity of the documents / information is found to be doubtful. You hereby undertake to indemnify and keep indemnified Payso against any and all losses, claims, liabilities costs etc. which arise out of or relating to your failure to identify yourself and validate your account promptly and / or due to incorrect KYC documents / information.
Refund and Cancellation Policy
The customer should contact the merchant directly in order to receive a refund. The merchant can then intimate Payso to process the refund to the customer if it is a valid concern. Post receiving the intimation from Merchant, Payso will process the refund in the next 3 working days and it may take upto 7 business days for the refund to show on the customer?s account.
Payso does not charge a fee to a Buyer for using Payso services. The financial institution that issues your Payment Instrument may charge a fee in connection with the debiting or charging of the Payment Instrument resulting from the Payment Transaction. You should consult the terms and conditions governing your Payment Instrument for more information about any such fees.
Errors and Unauthorized transactions
Notify Payso of Account Errors. Contact Payso immediately at Customercare@Payso.in if you think that: (a) your Account has been accessed without your authorization, (b) a transaction that you did not authorize has occurred, (c) a transaction has been processed incorrectly to or from your Account, or (d) your Account statement contains an error regarding your transaction history (each, an "Error"). If you give someone access to your Account and they conduct transactions without your authorization, these transactions are not considered Errors, unless you are the victim of a phishing attack or similar exploit. We must hear from you within 15 days after we provided the Account statement on which the suspected Error first appeared.
Consent to receive electronic communications.
By registering yourself with Payso and using the Payso Services, you consent to receive all Communications from Payso electronically and you confirm that you can access, receive and retain such Communications. "Communications" means all communications, terms, disclosures, notices, and statements that Payso provides to you in connection with your Account and your use of the Payso Services. Payso provides communications to you by posting them on Payso.in or by emailing them to you at the email address associated with your Account. A Communication will be considered to be received by you within 24 hours after the time we post it to our website or email it to you.
No Representations Or Warranties
The services provided on this Web site and the content, information, documents, graphics and images published at this Web site could include inaccuracies, typographical errors or other errors. We make no commitment, however, to update what is contained in this Web site. Furthermore, we reserve the right to temporarily, or permanently, modify, alter, discontinue or delete the same without prior notice. Consequently,

We assume no responsibility for the accuracy, integrity, quality completeness, usefulness or value of any content, data, documents, graphics, images, information, advice, or opinion contained in any e-mails, message boards, chat rooms or community services, or in any other public services, and do not endorse any advice or opinion contained therein. We do not monitor or control such services, although we reserve the right to do so. We may take any action we deem appropriate, in our sole discretion, to maintain the high quality of our service and to protect ourselves and others.
We assume no responsibility for any direct, indirect or consequential damages occurred to user while availing this facility, arising out of any error in the facility and which are beyond control of Payso and when Payso acted in good faith.
We collect the following: Registration information - When you sign up for Payso, you are creating a Payso account that is associated with your mobile number. Depending on the Services of Payso you use, you may be asked to provide information such as your name, Email id, Payment Instrument information ( Bank name, PPI/wallet name, CRN No, account number for the account, if applicable), date of birth, and/or your PAN number. Information obtained from third parties - We may obtain information about you from third parties, including third party verification services, information arising from Payso transactions at merchant locations, information regarding your use of payment methods issued by third parties that are linked to the Payso service, and information regarding access to balances held in your Payso account. Transaction information - When you use Payso to conduct a transaction, we may collect information about the transaction, including: Date, time and amount of the transaction, the merchant's location, a description provided by the seller of the goods or services purchased, any photo you choose to associate with the transaction, the names and email addresses of the seller and buyer (or sender and recipient), the type of payment method used, your description of the reason for the transaction, and the offer associated with the transaction, if any.
How we use the information we collect
We use the information you provide us, as well as information about you from third parties, in order to provide you with Payso services, and to protect you from fraud, phishing or other misconduct. Such information may also be used to assist third parties in the provision of products or services that you request from them. Information will also be used to provide you with customised offers from merchants for their products or services. Your registration information is stored in Payso servers and your registration of a payment method with a valid payment instrument will be stored on servers compliant with Reserve Bank of India (RBI) guidelines prevalent at the said time. All payment instrument related data is stored in PCI DSS Level 1 certified databases. In addition, certain data elements may also be stored on your mobile device.
Information we share
By accepting the terms and conditions the customer accepts that Payso may send the alerts to the mobile phone number or Email id provided by the customer while registering for the service or to any such number replaced and informed by the customer. The customer acknowledges that the alerts will be received only if the mobile phone is in 'On' mode to receive the SMS or on the Email id provided it is valid, active and updated Email id with Payso and If the mobile phone is in 'Off' mode then the customer may not get / get after delay any alerts sent during such period. The customer acknowledges that the SMS/EMail service provided by Payso is an additional facility provided for the customer's convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the customer observes any error in the information provided in the alert, Payso shall be immediately informed about the same by the customer and Payso will make best possible efforts to rectify the error as early as possible. The customer shall not hold Payso liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by the customer on account of the SMS facility. The customer acknowledges that the clarity, readability, accuracy, and promptness of providing the service depend on many factors including the infrastructure, connectivity of the service provider. Payso shall not be responsible for any non-delivery, delayed delivery or distortion of the alert in any way whatsoever. By accepting the terms and conditions the customer acknowledges and agrees that Payso may call the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer, for the purpose of collecting feedback from the customer regarding their usage of services.
Without limiting the generality of the foregoing, in consideration for our providing such services, you also agree not to:
- Violate any applicable law, regulation or rule;
- Harass, offend, threaten, embarrass, distress or invade the privacy of any individual or entity;
- Post or transmit any commercial, advertising or promotional materials, including without limitation, "spam" or mass distributions;
- Provide false information on your registration form or impersonate another person at any point;
- Post or transmit false, inappropriate, improper, disorderly or excessive messages or information.
- Post any material that infringes upon any third party's copyright, trademark, patent or other intellectual property right.
If you violate such terms, we may, without prior notice and without any liability to you Payso, restrain/prohibit you from any and all services, terminate your registration, delete your messages or postings, and take any other action we deem appropriate in our sole discretion. With reference to any services we provide, you acknowledge that we may, from time to time, without notice to you and at our sole discretion, establish various practices, limitations and restrictions for administering such services, including without limitation: how often a service or account may be accessed; the maximum number of days that messages or postings will be retained; the maximum number of messages or postings allowed; the size and nature of messages and postings; the maximum storage space available for an account; and all other matters related to administration of services, and you agree to be bound by such practices. You agree that we Payso is are not responsible or liable for deactivation or deletion of accounts or for loss of e-mails, communications, postings, data or information as a result of, or arising out of, our administration of such services.

You are responsible for maintaining the confidentiality of your password and account information and are fully responsible for all conduct carried out under this password and account. We are not liable for any loss of confidentiality or for any damages arising from your failure to comply with these terms. You will promptly report any unauthorized use of your password to us.
Limitation of Liability
In no event will we, our officers, employees, contractors, subcontractors, suppliers, agents, affiliates, subsidiaries, successors or assigns be liable to any party for any direct, indirect, consequential, incidental, special or other indirect (including without limitation, cost of cover) arising out of or in connection with this agreement or any services, content or other materials provided or available hereunder, or use of any other links or linked web site, even if we are expressly advised of the possibility of such damages, and regardless of whether such damages arose in contract, tort (including negligence), strict liability or other legal basis. The term "damages" includes, without limitation, attorney fees, any lost profits, business interruption and loss of programs or other data on your information handling system. You acknowledge that the economic terms of our agreement reflect the foregoing allocation of risk and such allocation of risk is a significant inducement for us to provide the services, web site and other content and materials.
Ownership & Proprietary Rights
The Services, platform and the app are owned and operated by Payso and/or third party licensors. The visual interfaces, graphics, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Services and the Site provided by Payso (the "Materials") are protected by Indian copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws. As between You and Payso, all Materials, trademarks, service marks, and trade names contained on the Site are the exclusive property of Payso and/or third party licensors or suppliers. You agree not to remove, obscure, copy or alter Payso or any third party's copyright, patent, trademark, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Services. Except as expressly authorized by Payso, You agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Materials. Payso reserves all rights not expressly granted in this Agreement. If You have comments regarding the Services and the Site or ideas on how to improve it, please contact customer service. Please note that by doing so, You hereby irrevocably assign to Payso, and shall assign to Payso, all right, title and interest in and to all ideas and suggestions and any and all worldwide intellectual property rights associated therewith. You agree to perform such acts and execute such documents as may be reasonably necessary to perfect the foregoing rights.
Nothing contained in this Web site shall be construed as conferring any license or right, expressly, by implication, by estoppel or otherwise, under any of our intellectual property rights, or under any third party's intellectual property rights, and no part of this Web site may be reproduced, republished, copied, transmitted, or distributed in any form or by any means.
Publicity and Advertising
You acknowledge and agree that you shall not use the Payso name and/or trademark/ logo in any sales or marketing publication, promotional literature or advertisement, or in any other manner.
Grievance Redressal Mechanisms
1) Principles Governing Company's policy:
- Customer shall be treated fairly at all times.
- Complaints or concerns raised by the customers are dealt with an open mind, with courtesy and in a timely manner.
- Customers shall be fully informed of avenues for grievance redressal within the organization and their rights if they are not satisfied with the resolution of their complaints.
- Payso will take care of all complaints efficiently and fairly as they value each customer.
- All employees at Payso must work in good faith and without prejudice to the interests of the customers.
2) Registration of Complaints:
Function and Authority
The Customer Support is responsible for the resolution of queries of all customers. The Officer-in-Charge of Customer Support is responsible for ensuring resolution of all queries received at Customer Support to the customer's satisfaction. The Company has a Customer Support facility for effective resolution for operational issues and all the grievances referred to it.

4) Periodic Review:
The Management keeps periodic Reviews to ensure smooth functioning of Customer Grievances Redressal.
*Customers are requested to raise the concern to next level only if they do not get a resolution within the time frame mentioned above. This will help us in resolving your concern in a smoother way.
Grievances between System Participants in respect of any matter connected with the operation of the payment system shall be resolved in accordance with the relevant provisions of the Payment and Settlement Systems Act, 2007, as may be amended from time to time.
Technical Issue and Delivery Policy
Payso shall not be liable / responsible, in any manner whatsoever, for any loss / liability arising out of or relating to any technical failure / issue in Platform and / or acts / omission not attributable to Payso.
You agree to hold harmless, defend and indemnify Payso, its officers, directors, employees, subsidiaries, representatives, contractors, subcontractors, suppliers, agents, partners and affiliates, successors and assigns from all liabilities, claims, demands and expenses, including reasonable attorneys' fees, that are due to, or that arise from your use or misuse of this site, any services therein, or for infringement by you or others of intellectual property rights or other right of any third party. We may assume exclusive control of any defense or any matter subject to indemnification by you, and you agree to cooperate with us in such event.
No Illegal use of Services
You shall not access and/or utilize the services for illegal purposes and will not interfere or disrupt networks connected with the services.
Payso may elect to resolve any dispute, controversy or claim arising out of or relating to this Agreement or Service provided in connection with this Agreement by binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996. Any such dispute, controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Mumbai, India and judgment on the arbitration award may be entered in any court having jurisdiction thereof. The decision of the arbitrator shall be final and binding on both the parties. Either you or we may seek any interim or preliminary relief from a court of competent jurisdiction in Mumbai, India, necessary to protect the rights or the property of you or Payso (or its agents, suppliers, and subcontractors), pending the completion of arbitration. Any arbitration shall be confidential, and you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of the arbitration award. All administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own lawyers and preparation. The language of Arbitration shall be English.
Governing Law and Forum for Disputes
Except as otherwise agreed by the parties or as described in the Arbitration section above, you agree that any claim or dispute you may have against Payso must be resolved by a court located in Mumbai, India. You agree to submit to the personal jurisdiction of the courts located within Mumbai, India for the purpose of litigating all such claims or disputes. This Agreement shall be governed by the laws of India, without giving effect to any principles of conflicts of law.
Payso is not responsible for any of the products or services that you purchase or rewards or other incentives that you earn using a credit, debit, or rewards card that you access with Payso. Payso is an independent contractor for all purposes of the services that it provides to you. Complaints regarding products, services, and rewards and incentives programs must be directed to the Vendor and, in the case of complaints regarding rewards, you may have recourse to the Card Issuer or another third party involved in providing or administering the rewards program. You also may have certain refund, reversal, chargeback, or other rights with respect to the Card Issuer pursuant to your agreement with the Card Issuer or under applicable law.
YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT THE FOLLOWING DISCLAIMERS. WE ARE PROVIDING OUR SERVICES ON AN "AS IS" BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR MEMBERS USE OUR SERVICES OR THE FEATURES, SERVICES, AND INTERFACES OUR SERVICES PROVIDE. Notification of Changes
